In this action plaintiffs sought to recover for damage to their automobile which was partially demolished in a collision with a pick-up truck owned and operated by the defendant. It was alleged in the complaint that the collision was proximately caused by the negligence of the defendant. In his answer defendant denied generally all of the allegations of plaintiffs' complaint and asserted that the negligence of the driver of plaintiffs' car contributed proximately to cause the collision. A trial of the action in district court resulted in a verdict and judgment for plaintiffs. Thereafter the defendant moved for judgment notwithstanding the verdict or in the alternative for a new trial. This motion was denied by the trial court and defendant has appealed both from the order of denial and from the judgment. The specifications of error may be summarized under two headings: 1. That the evidence is insufficient to show any actionable negligence upon the part of the defendant.
